Gtony Inc., Aqua V End-User Software License Agreement
You must carefully read the following terms and conditions before using this software which can be downloaded from the Gtony website, along with any accompanying documentation.
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
Gtony Inc., may from time to time issue upgrade versions of the Software, and he updated versions may be found on the website www.gtony.com. Also, Gtony Inc. may revise the End-User License Agreement from time to time without noticing the users. The new version of the End-User License Agreement will be posted up on the website, www.gtony.com. If this software version number is older than the recent version, please look for the updated information to ensure that your use of the Software comprise with the new agreement.
By clicking the Yes button below, you are agreeing with all the terms and conditions and to be bounded by the agreement. If you do not agree with these terms and conditions, please click no, then the installation will discontinue, therefore, you are not licensed to use any part or portion of this software and documentations.
1. SINGLE COPY SOFTWARE LICENSE.
The software is copyrighted and protected by law and international treaty. You may download the software through a Web browser onto a single computer for your personal, non-commercial internal use only, unless specifically licensed to do otherwise by Gtony, Inc. A registered copy of the Software may be used and accessed through a LAN (Local Area Networks) environment, given that you are licensed to all the computers accessing the LAN. All the computers must have each individual registration.
2. TERMINATION OF THIS LICENSE.
Gtony, Inc. may terminate this license at any time if you are in breach of any of these terms and conditions of use. Upon such termination you must agree to immediately destroy all copies of the software.
3. DISCLAIMER.
The software is provided ügas-is.üh Gtony Inc. makes no representations or warranties of any kind, express or implied, as to the software or its operation. To the full extent permissible by applicable law, Gtony Inc. disclaims all warranties, express or implied, including, but not limited to, implied warranties or merchantability and fitness for a particular purpose, and any warranties of non-infringement. Some jurisdictions do not allow or otherwise govern the scope of exclusions of implied warranties, so that above exclusions may not apply in full.
The software may contain technical inaccuracies or typographical errors, so changes and/or updates may be affected without notice. Gtony, Inc. may also make improvements and/or other changes to the software at any time without notice.
4. LIMITATION ON DAMAGES.
In no event Gtony Inc. will not be liable to any party for direct, indirect, special or other consequential or incidental damages arising directly or indirectly from the use of the software, including but not limited to any lost profits, business interruption, loss or programs or other data on your information handling systems and so on, even if Gtony Inc. has been expressly advised of the possible cause of such damages.
5. Restrictions
Except as otherwise expressly permitted in this Agreement, Licensee may not:
(1) Modify or create any derivative works of the Product or documentation.
(2) Recompile, disassemble, reverse engineer, or otherwise attempt to derive the source code for the software
(3) Redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer rights to the software
(4) Publish any results of benchmark tests run on the Product to a third party without permission from Gtony Inc. Plug-ins and product components provided with or as part of the software may be used only with the Product and not on a standalone basis or with any other product.
6. Trial Version Software
The trial version of the software may be distributed without permission from Gtony Inc in its original, unmodified format. You are prohibited to change the any contents of the software or the documentations. You are allowed to store the software in any removable media, but are not allowed to charge anyone for the software. If you would like to distribute the software for some reasons, you must contact Gtony Inc before you do so.
